This agreement is a contract between you (the “customer”) and Howard Park Wines Pty Ltd 11062755391. Howard Park Wines Pty Ltd operates under the West Australian Liquor License numbers: Margaret River: 6180053900 and Denmark: 6180033365, owns the website www.howardparkwines.com.au and is the supplier of wines via the website.
All orders are processed and distributed by Howard Park Wines Pty Ltd. Our offers are transmitted from our licensed premises at Miamup Road Cowaramup WA 6284 and Scotsdale Road Denmark WA 6333.
Persons under 18 years of age are not permitted to place orders for alcohol.
www.howardparkwines.com.au supports the responsible service of alcohol.
The terms and conditions under which you may purchase products from howardparkwines.com.au are set out below. Please read the following terms and conditions carefully before placing your order with howardparkwines.com.au.
By completing the customer application process and using the howardparkwines.com.au service, you acknowledge that you have read and understood these terms and conditions and agree to be bound by the terms and conditions of this Agreement.
PURCHASE ORDERS & DELIVERY OF GOODS
Delivery Area
Howard Park Wines provides delivery of goods across Australia. Howard Park Wines does not currently ship to international markets.
Orders:
To place an Order with Howard Park Wines:
(a) Selecting Goods on howardparkwines.com.au website, entering your Personal Details and pressing the "add to cart" and “process order” button; or
(b) Selecting Goods and instructing Howard Park Wines by telephone that you wish to purchase the Goods, and providing your Personal Details to Howard Park Wines; or
(c) Selecting Goods and instructing Howard Park Wines by facsimile that you wish to purchase the Goods, and providing your Personal Details to Howard Park Wines; or
(d) Selecting Goods and instructing Howard Park Wines by e-mail that you wish to purchase the Goods, and providing your Personal Details to Howard Park Wines; or
Authorised Receipt of Goods
Anyone at the Delivery Address who receives the Goods shall be presumed by Howard Park Wines to be authorised to receive the Goods on your behalf.
Under law, alcoholic beverages can only be sold or supplied to persons aged 18 years of age or over. By placing an order, the buyer confirms they are at least 18 years of age. If buying wine as a gift, the recipient must also be at least 18 years of age.
RISK AND TITLE
Upon delivery of the goods to the customers chosen address, the risk and title of the goods passes to the customer.
Returns and Refunds
If you are not satisfied with the quality of the Goods you have received from Howard Park Wines contact us at our Howard Park Wines cellar door on (08) 9756 5200 or email hpw@hpw.com.au within two weeks of receipt of goods.
Returns: Where wine is to be returned Howard Park Wines will arrange to collect the wine from the buyer at a mutually convenient time. The buyer must keep the wine in a safe and proper manner and take reasonable care of it, wine should be returned in its original packaging or packed to avoid breakage during transport back to Howard Park Wines.
Refunds: If a refund of product is deemed appropriate, Howard Park Wines will affect the refund within 30 days of return of product to the winery.
PRICE OF GOODS & PAYMENT
Price of Goods
The price the customer will pay for goods ordered will be the price specified on the product list plus delivery fees to ship the goods to the specified destination. All prices quoted are in Australian Dollars and include GST. Price variations do occur, the price paid will be the price quoted on the date of order.
Method of Payment
Howard Park Wines accepts payment by MasterCard, Visa, American Express and Diners card. Payment must be received in full prior to goods being dispatched.
INTELLECTUAL PROPERTY
The material displayed on howardparkwines.com.au is subject to copyright owned by Howard Park Wines Pty Ltd and is protected by law. Website visitors must not do anything to prejudice the rights of the logo or graphics associated with the Howard Park Wines brand.

NOTIFICATION OF CHANGES
Howard Park Wines may add to, delete, or otherwise change any of the terms of this Agreement without notice. In case of a modification, the pre-existing terms and conditions continue to apply to any products ordered via the website before the change takes effect.

Howard Park Wines may offer specials, promotions and discounts on www.howardparkwines.com.au. These promotions are available only while stocks last unless otherwise advertised.
